Who Is Able to Receive Compensation for the Destroyed Housing If the Owner Died?

The draft Law on Compensation for Damage and Destruction of Certain Categories of Immovable Property as a Result of Combat, Terrorist Acts, Sabotage Caused by Military Aggression of the Russian Federation 7198 of March 24, 2022, which is currently being prepared for the second reading, clearly clarifies who can receive compensation for destroyed housing if the owner died. This was announced by the chairman of the “Servant of the People” party, the chairman of the organization “For Great Construction” Olena Shulyak.

“Our bill №7198 on compensation for destroyed and damaged housing stipulates that if the owner dies, his heirs can receive compensation. If the deceased owner made a will, the persons specified in the will have the right to inherit”, she said.

If there is no will, the inheritance takes place in accordance with the law. Thus, the heirs receive the right to inherit in turn (each subsequent turn of heirs receives the right to inherit in the absence of heirs of the previous turn, removing them from the right to inherit, their non-acceptance of the inheritance or refusal to accept it):

• In the first place, the children of the testator have the right to inherit, including those conceived during the testator’s lifetime and born after his death, the surviving spouse and the parents;
• In the second place – the brothers and sisters of the testator, his grandparents, both on the father’s side and on the mother’s side;
• In the third place – the uncle and aunt of the testator;
• Fourth, persons who have lived with the testator in the same family for at least five years before the opening of the inheritance;
• In the fifth – other relatives of the testator up to and including the sixth degree of kinship, and relatives of the closest degree of kinship are excluded from the right to inherit relatives of the next degree of kinship.
