What to Do If Your Car Was Destroyed or Damaged During the War

Irpin, Bucha, Gostomel, Vorzel, Makariv – it was in these cities of Irpin region that the Russian occupiers, in violation of international law, committed atrocities against civilians and destroyed their infrastructure. As a result, thousands of people died and a new cemetery with the graves of the victims appeared, the scale of which is impressive, and all the cities were destroyed by more than 50%. In addition, a cemetery of shot, burned and mutilated cars appeared between Bucha and Irpin, many of which bear the words “Children”.

And if we already know what to do when real estate is destroyed or damaged as a result of the Russian-Ukrainian war, then what to do when it comes to movable property is not clear. The editorial board of Irpinsky Visnyk asked the lawyers for an algorithm of actions.

“Currently, the state has not officially provided a procedure for compensation for destroyed or damaged movable property as a result of Russia’s war against Ukraine and there is no algorithm for action. It is also unknown what kind of compensation Ukrainians can count on. However, in the future the government of our state envisages the introduction of such compensation. Everything will probably be the same as with destroyed or damaged real estate. It will be necessary to submit a certain package of documents for reimbursement to Actions. There is no list of these documents yet, but it may be similar to the one that will be submitted for real estate”, the lawyers explain.

But what can the residents of Irpin region do now?

• Gather evidence that your car was indeed damaged or destroyed. Make a photo and video recording and be sure to indicate the date and time and add a brief description of the events in the notes. If you are not able to record in this way – collect the testimony of neighbors or eyewitnesses: in general, any information found. The more materials – the better.
• Record the fact of damage or destruction of movable property by contacting the police with a statement about the commission of a criminal offense. In the future, when the appropriate procedure for compensation for movable property is developed, the owner will be able to attach to the package of documents an extract from the Register of pre-trial investigations on the fact of committing this criminal offense.

It is important to understand that Ukrainian citizens will be able to receive compensation for lost or damaged movable property only after the end of the war. At present, the main and important thing is to collect and submit all the necessary documents at the right time.
